Charter Review Committee 2012
On July 25, 2012, the Rio Rancho Governing Body approved a resolution activating a Charter Review Committee (view resolution and agenda briefing memo - both in MS Word).

The Governing Body specifically directs the Charter Review Committee to only consider the following: (1) review the duties and role of the Mayor position as defined in section 3.01 of the Charter; (2) make specific recommendations to define “full time” which is noted in section 3.01(B)(3) and states “Devote her/his full time to the discharge of mayoral duties and have outside employment only if the outside employment does not materially conflict with the performance of such duties;” (3) and make any other amendment recommendations to the Charter they believe are necessary and/or warranted in reviewing the duties and role of the Mayor.

Members
In accordance with sections 33.19, et seq., of the Rio Rancho Ordinances, 2003, membership in the Committee shall consist of seven members; one member to be appointed by each City Councilor from a resident residing within their respective district, and one member to be appointed by the Mayor from a resident at-large.

On July 25, 2012, the Rio Rancho Governing Body approved the following individuals to serve on the Charter Review Committee via resolution (view resolution in MS Word):

Mayor At-large - Dan Foley (Vice-Chairperson)
District 1 - Don Dulac
District 2 - Chris Neubauer
District 3 - Jerome Wade
District 4 - Steve VanHorn (Chairperson)
District 5 - Henry Pacelli
District 6 - Wes Bassett

At the first committee meeting on Aug. 6, 2012, a chairperson and vice-chairperson were selected by the committee.

Term/Submission of Recommendations
The term of the Charter Review Committee shall expire at midnight on Dec.12, 2012.

The Committee is requested to submit its recommendations to the Governing Body no later than Sept. 30, 2012. The Committee shall be dissolved once its proposed amendments are approved by a majority of the Governing Body or upon expiration of the term.

Process
The Governing Body has 30 days to either approve the recommended amendments submitted by the Charter Review Committee or refer the amendments back to the committee with suggestions. If the Governing Body approves the recommended amendments, an election resolution is brought forward so as to place the amendments on a ballot for voter consideration.

If the Governing Body refers some amendments back to the committee, then only those items can be considered. Once the committee has considered the appropriate amendments the committee has 30 days to re-submit them to the Governing Body.

This process continues until the recommendations are approved by the Governing Body or the committee reaches its expiration date.

At their regular meeting on Sept. 26, 2012, the Governing Body voted to not accept the Charter Review Committee's recommendations and consider a resolution to repeal the creation of the committee at their Oct. 10, 2012, meeting. At their Oct. 10, 2012, meeting, the Governing Body approved disbanding the Charter Review Committee.
